Travel Contract and liabilities: The travel contracts
regarding the present programme are regulated by Law 1084, dated 27/12/1977 which ratified
and implemented the International Convention of Travel Contracts (CCV) signed in Brussels on
23/04/l970, and as from 14/10/1995 by the Ordinance n.111 of 17/03/1995 realised by the EEC
regulation 314/90. The liability of Holeq Viaggi can in no way exceed the limits foreseen by
the above mentioned Law.
Bookings: Bookings are accepted until no further places are available, and they are
held to be confirmed by Holeq Viaggi, Via Destra del Porto 27a/b-Rimini-ltaiy, under the
conditions which follow.
Payment: Bookings shall be held valid only if at the moment of confirmation a deposit
equal to 30% of the total cost of the package tour is sent. The balance must be paid at least
10 days before the scheduled departure date. For bookings confirmed under 10 days before the
departure date, the deposit and the balance must be paid at the same time. Non-payment of
deposit and/or balance may lead to cancellation of the booking by Holeq Viaggi.
Cancellations: If a client cancels, Holeq Viaggi will apply the following penalties
besides any costs involved in the cancellation: - 25% of the total cost if the cancellation
is notified to Holeq Viaggi at least 21 days before the departure date of the holiday booked;
- 50% of the total cost if the cancellation is notified to Holeq Viaggi at least 11 days
before the departure date of the holiday booked; - 75% of the total cost if the cancellation
is notified to Holeq Viaggi 3 days before the departure date of the holiday booked; No refund
within 3 days of departure date.
Cancellation without penalty: The client is entitled to cancel the contract without
payment of a penalty only under the following conditions: - An increase in the prices of over
10% - A significant change in the details of the contract by Holeq Viaggi after the contract
has been drawn up, on condition that the client notifies Holeq Viaggi in writing of his
intention to accept or reject these changes within 2 working days of notification of the
changes. In such cases the client will have the right to a refund of all amounts already paid
or alternatively the right to another package tour of equivalent standard.
Interruption of holiday: In the case of a holiday being interrupted by the client, no
reimbursement will be paid, unless the client is able to present a clear and specific
declaration by the hotel management and/or the service provider that they agree to a
reimbursement for unused services. Such a procedure is absolutely necessary and Holeq Viaggi
will only reimburse the sum authorised by the hotel and the service providers, having
deducted the expenses of the said Agency. |

Changes after departure: Whenever a part of the planned
tour as specified in the contract cannot take place or a service previously agreed cannot be
offered, Holeq Viaggi will arrange an adequate alternative in order to ensure the
continuation of the planned journey which does not involve any further charge to the client,
or the said organiser will arrange a reimbursement to the client according to the difference
between the service as originally agreed and that which was supplied, with the exception of
any damages.
Complaints: Any non-fulfillment of the contract must be contested by the client
without delay, by informing Holeq Viaggi so that the latter can intervene directly or through
its local representative, so as to immediately remedy the situation. Any written complaint
must be sent to Holeq Viaggi by registered post within ten working days of the date of return
to the point of departure. Any complaint received after this time will be declared
invalid.
Insurance: Holeq Viaggi is insured for civil and professional liability with the
insurance company "CEA SpA" (Compagnia Europea di Assicurazioni) policy No. 54218,
in accordance with Reg. Law 31 article 6, dated 2/04/98.
Variations: Holeq Viaggi reserves the right to substantially modify one or more
elements of the contract whenever this is rendered necessary for serious reasons. Should the
client not agree to accept these modifications, Holeq Viaggi will only reimburse the payment
made. Non-agreement must be notified by the client in writing within two working days of
notification of the proposed changes.
Prices: All hotel prices are net, per person, per day, VAT included (in effect at the
time of printing the brochure). In the event of an increase in VAT the prices will be
adjusted accordingly. Prices do not include extras, tips, transfers, excursions, entrance
fees and anything else not specified.
Place of Jurisdiction: For any contestation and/or controversy the place of
jurisdiction shall be Rimini Court. For any matters not expressly mentioned in these
conditions, reference shall be made to the legislation in force.
Booking fee: a non-refundable booking fee of 20,000 Itl. per person is payable in
addition to the price of the package. Booking fee includes insurance and medical assistance
CEA Assistance.
Technical organization: Holeq Viaggi di Biemme srl. - Via Destra del Porto 27 A/B -
